BalanceUp Terms of Service

1. Acceptance of Terms

By downloading, accessing, or using the BalanceUp mobile application ("App"), owned and operated by QuailSofts LLC, you agree to be legally bound by this User Agreement. If you do not agree, you may not use the App.

2. Eligibility

You must be at least 18 years old to use BalanceUp. By using the App, you confirm that you meet this requirement and are legally permitted to enter into this agreement under applicable U.S. law.

3. License & Restrictions

QuailSofts LLC grants you a limited, non-exclusive, revocable license to use the BalanceUp App for personal, non-commercial purposes only.

You agree not to:

• Reverse engineer, decompile, or modify the App.
• Share unauthorized copies or credentials.
• Use the App in violation of any law or third-party rights.

Bank Account Linking

• BalanceUp uses Plaid Inc. ("Plaid") to securely link financial accounts.
• By linking an account, you authorize Plaid to access and transmit your financial information on your behalf for the sole purpose of enabling BalanceUp features (transactions, categorization, and budgeting).

4. Account Security

• You are responsible for maintaining the confidentiality of your account login information.
• BalanceUp uses Firebase Authentication to secure accounts.
• QuailSofts LLC is not liable for losses arising from unauthorized access resulting from user negligence (e.g., weak passwords, device sharing).

5. User Content & Conduct

You may create, upload, or post content within the App (e.g., budgets, goals, posts in the community forum).

You agree not to submit content that is:

• False, misleading, or fraudulent.
• Infringing on intellectual property rights.
• Harassing, abusive, offensive, or illegal.

QuailSofts LLC reserves the right to moderate, restrict, or remove content that violates these rules or community standards.

6. Privacy

Your use of the App is also governed by the BalanceUp Privacy Policy, which explains how we collect, use, and protect your data.

7. AI Insights Disclaimer

BalanceUp provides AI-powered insights through third-party services (OpenAI). These insights are intended for educational and informational purposes only and do not constitute financial, legal, or investment advice. Users remain solely responsible for their financial decisions.

8. Modifications

We may update this agreement to comply with legal, technical, or operational requirements. If changes are significant, we will notify you through the App or email. Continued use of the App after updates constitutes acceptance of the revised terms.

9. Compliance

BalanceUp complies with:

• Applicable U.S. privacy and consumer protection laws.
• Apple App Store and Google Play Store developer policies.
• International frameworks including GDPR (for EU users).

10. Termination

We may suspend or terminate your access to BalanceUp if you:

• Violate these Terms of Service.
• Use the App unlawfully or in a manner that could harm others.

11. Subscriptions & Billing

BalanceUp offers auto-renewing subscription plans:

• Monthly Plan: $8.99/month.
• Annual Plan (Launch Special): $69.99/year (locked for founding members).
• Standard Annual Plan (after Year 1): $89.99/year.

Billing & Renewals

• Subscriptions are processed securely through the Apple App Store or Google Play Store.
• Your subscription automatically renews unless you disable auto-renew at least 24 hours before the end of the billing period.
• You may manage or cancel your subscription at any time through your App Store or Google Play account settings.
• Refunds are handled in accordance with Apple or Google's policies. QuailSofts LLC does not issue refunds outside of platform policies or legal requirements.
